Q: Do I need to hire an attorney in FL if the deputy that gave my daughter a speeding ticket, wrote my name on the ticket?
I cosigned for my daughter's car, so both of our names are on the title and registration. She was stopped for speeding, got a ticket, didn't have her driver's license with her, tried to give the deputy her driver's license number, but he didn't take the info. He just wrote the ticket in my name because my name is the 1st name on the car registration. I called the deputy in Pinellas county FL. He told me that he can't change the name on the ticket, and that I have to appear in court, not my daughter. My daughter gave me her phone video of the incident. The deputy was subpoenaed, but never served. The subpoena was returned. Do I need to hire an attorney? Or is the video proof? The deputy has a bodycam video, but he probably won't show up in court. And I thought a person was supposed to have some kind of consequences for not having their driver's license. Are deputies allowed to issue speeding tickets to people who are not the one driving the car? I live in Deltona, FL daughter in St Pete
A: You and your daughter need to attend the hearing, you as the defendant and your daughter as your witness. In most places, the officer who issued the ticket will attend and a subpoena is not necessary. If the deputy fails to attend you or your attorney should ask that the case be dismissed. Be prepared for the court to keep the video, so don't just bring your phone; bring it on a medium that you don't want to keep.
