Rochester, NY asked in Criminal Law for New York

Q: I have a criminal summons for harassment in the second, no physical violence and I don't have a record. I have a witness

Should I acquire a lawyer or defend myself. The young lady who is claiming the harassment was harassing me. It all started when my fiance tapped her bumper, she began to rant and rave I was a passenger in the backseat. She targeted me refused to allow me out of the car and began screaming I want your information someone's going to give me information. I told her I would give her nothing she became even angrier.so when I finally reacted and told her to get the f away from me or I would f up, she made sure her camera was recording so she can show the police and claimed I was harassing her now I have to go to court. she was from Texas and should have been in quarantine I asked her multiple times to get away from me and my child because she was endangering our lives she refused ,so I became angry and reacted but no physical violence was involved . I never touched her. What should I do, my court date is September 1st. Thank you

A: For the charge of harassment in NYS there does not necessarily have to be physical contact. You may wish to see if there are cameras around which caught the incident. A private investigator can do this on your behalf. I would be happy to go over your paperwork and advise you regarding your case. The initial phone call to discuss your options would be free of charge. Call me if you wish to discuss your case.

A: Although it sounds like are charged with a violation (240.26), you should consult with an experienced criminal defense attorney for proper representation. You really should not to go to court alone without counsel.
