Q: Ex is fighting for 50/50 parenting even though our daughter was sexually abused by his girlfriend's son.
My ex is fighting for 50/50 parenting even though he allowed his GF's son to sleep in bed with our daughter even though 2 days prior we were in court and it was a court order that she is never to sleep in bed with anyone at her dad's house, but he broke that court order which resulted in a ER visit that concluded there appeared to be vaginal trauma. My daughter at first said she didn't remember what happened (she's only 5) which gave cps and the detective no choice but to close the case since the perpetrator is also a minor. But after being in therapy she finally disclosed what happened to her which was that the older child did assult her. The ex refuses to believe it and is fighting in court to get 50/50 time and also allow the child and his girlfriend to be allowed back in our daughters life. How likely is it that my ex will get 50/50 after everything that has happened to our daughter on his time?
A: Highly unlikely if properly documented and investigated.
