Q: Can dog seller who did not provide any paperwork sue me for animal abandonment when I did not receive the dog?
I paid for the dog through Zelle online. There was no paperwork. They said they took the dog to a delivery service, the service wanted me to zelle them additional $1,500 or provide gift card of equivalent amount for the crate. I wasn't aware I was supposed to rent electronic crate. After much research, I found out the breeder is fake and website is fraud. The seller said they will sue me in court for abandonment because I wasn't willing to pay for the crate. This amount is supposed to be refund. But it all sound so fishy. The seller said that he or she has no right to get the dog back because it's not under their name anymore. Everything began to sound fishy. I am not expecting my money back, but can they sue me in court? It doesn't make sense and it's stressful. Thank you.
A:
They can sue you for anything. You can counter sue them for concealing material terms of the sale of the dog. It sounds like you were scammed, I would like to see them in Court. For your case of fraud, you can recover the cost of the dog, your emotional distress and punitive damages against this seller.
