Staten Island, NY asked in Car Accidents for New York

Q: Hit my personal car while driving Penske truck with insurance on it

Looking for advise if i have a case in small claim court NY

Rented Penske track with insurance on it. While making wide turn hit my personal car which was on public road parked with no one inside. Damaged 2 doors and repair is very expensive

Contacted Penske by they refused to help indicating that their insurance covers only third party and i become a first party.

Exact verbiage in the contact

supplemental liability insurance (sli) protects you against against claims made by a third party for bodily injury and/or property damage sustained as a result of an accident while you are operating a rental vehicle

I disagree with their decision and planing to take them to a small claim court.

Do i have any chance to win ?

Yes, i do have personal car insurance but i don't want to claim just because of deductible and future rate increase.

My point here is that at the time of renting Penske truck i purchased the insurance which supposed to cover accidents

A: Slim chances. What about the insurance on your personal car?

A: I agree with my colleague - the insurance contract covers you in the event you damage someone else's property or cause them personal injuries. Supplemental liability insurance does not cover you for causing damage to your own vehicle. If the cost of repair is that expensive you might want to consider paying the deductible and having your own insurance pay for the damage.
