Q: Can my expunged records be use against me in another case in Maryland's courts?
A: No. Maryland Criminal Procedure Code, Sections 10-108 and 10-109, prohibit disclosure of an expunged record or information from that record to another person without a court order. Violation of these sections is a criminal offense that carries up to one year in jail. For a public employee or official to violate these sections, in addition to prosecution, they may be terminated and removed from public employment or service. If the use of the material is necessary to defend or respond to allegations or claims being made by you, however, in a court proceeding, then a court may determine that you put the matters contained in the records into issue in the legal proceeding, and therefore opened the door to their admission into evidence.
