A: If there is no Court order establishing possession of, access to or custody of the child, then each parent has equal rights to the child. As a practical matter, father may have to go to Court though to get Orders granting him visitation.

A: No. But, the father should hire a lawyer to establish himself as a legal father and get a court order that outlines who the child will live with, where the child is allowed to live, visitation, child support, and medical support.
