Cincinnati, OH asked in Car Accidents for Ohio

Q: Do I have a case?

I was hit by a semi in the back of my car which turned me sideways and then pushed down the highway for several minutes. The police report stated they couldn’t determine who was at fault even though the driver of the truck stated he didn’t see me. I am still paying on my vehicle so I had full coverage insurance at the time. My payment was due October 17th , the exact date of the accident. It happened early ,around 6 am, so I had not made my payment yet . When I did pay it that same day they made me open a new policy since I had been in an accident. When I filed my claim it was denied and they said I wasn’t covered at the time of the accident. I was 8 months pregnant and my six year old child was in the car. I am still driving this car it is severely damaged and I still owe on it. Is there anything I can do either with my insurance company or the other driver?

A: An Ohio attorney could advise best, but your post remains open for two weeks. It's terrifying to think that an eight-month pregnant woman with a six-year old child in a car small enough not to be seen from the cab of a truck was pushed down the highway for minutes. If you reached out to Ohio attorneys, I'm confident most would listen to details about your experience in a free initial consult. Good luck
