Q: Im looking for more information on common law marriage

I’m looking at if me and my spouse qualify for common law marriage and what steps do we need to take to become a common law marriage. We have been living together for 2 years. I do live in Houston, Texas

A: In Texas, in order for a common law marriage to exist for a couple, there are three requirements: 1) both parties agree to be married, 2) the two hold themselves out to the public as married, and 3) they must live together (for any amount of time). Some people prefer to document a common law marriage by filing a declaration with the County Clerk's office. Your local County Clerk's office can help you find the forms.
