Q: Can my daughter decide who wants to live with it? She is 16.

What form i need to fill out, to get custody of my daughter?

A: Generally speaking in custody cases the court bases its decision on the best interest of the children. One of the factors when attempting to determine the best interest is preference of the child. If you file a motion with the court to change custody, include that your daughter wants to lives with you and request a child interview. If the child interview is granted your daughter will speak to a Court representative and she will be able to give her preference to the court.

A: In Nevada, the court determines all cases involving children on what is in the best interest of the child. While a teenager’s preference may very well be a factor in determining the child’s best interest it is not the only, nor the most important factor the court will look at. You would begin by filing a motion for child custody and in doing so request that because of your child’s age and maturity level that she be interviewed and that her living preference be considered.
