Dade City, FL asked in Car Accidents, Civil Litigation and Criminal Law for Florida

Q: If the driver dies in a car accident in Florida, & they are driving someone else car with no license, who is responsible

I borrowed my girlfriends car. I told my sister she could use it to take her boyfriend home. She didn't & instead asked a friend to drive hin using my girlfriends car. The friend driving my girlfriends car wrecked & was killed. Would the owner of the car insurance cover the cost of the funeral? What if the driver was over 18 and didn't have a license? Can my girlfriend sue me since I originally borrowed the car or my sister who I gave the keys to & in turn gave them to the person who died? Who would be liable for the other vehicle involved & the passengers inside medical bills? Please help me understand where everyone involved in this stands criminally & civilly because I need to know which way to go with this.

A: 1. The short answer to most of your questions is that the insurance company that insured the car that was wrecked is the best source to get answers to all of your many questions.

2. Second guessing them I will only say that you and your sister and everyone else involved here have DIFFERENT status and thus will be treated differently by the insurance company and any law enforcement involved.
