Q: Looking to obtain any advice on how to handle a largely complicated traffic matter that has accumulated over 20 years.
I've never held a MD driver's license. However, my license has been "suspended" since 2000. As a result I have $1300 in fines and 8 points. But have never had a license....
I was cited for driving on suspended 01/17/2020. Scheduled for hearing 12/28/2020 due to covid postponements.
I am desperate to resolve the current matter as well as all previous obligations. I am at a loss as to how to navigate the issue.
A: Points only stay active on your driving record for two years from the date of the violation. The MVA sends a notice of suspension or revocation based on point accumulation within any two-year period of 8, 12 or more points, or conviction of certain serious traffic offenses (like DUI). Unless you request a hearing on the proposed suspension within the time provided, the suspension or revocation term in the letter is imposed. Once the suspension or revocation periods have expired, you may remain suspended or revoked until you apply to reinstate your privilege, or in your case, apply for your fist license. You will need to do everything required to obtain a MD license. If this is your first license anywhere, then you will need to take a driver’s education class, obtain your learner’s permit, pass the written and physical driving tests, etc. You either do that or stop driving without a license and while suspended. That’s the only way to “end” this situation. Of course, you are facing 12 more points, $1,000 fine and a year in jail on the upcoming court date, which if convicted will set you back even further. You need a lawyer. You also need to start the process to get licensed NOW so you can show the judge that you have finally started the pathway off this merry go round of driving without a license and court appearances. Maybe, just maybe, if you show you’re serious about fixing your license issue, the prosecutor and/or judge can be persuaded to not set you back again with 12 more points and another year of a suspension or revocation period. A lawyer is your best bet to make that happen. No guarantees, but you have not helped your situation to date. Waiting until the month before trial to start is late, but better than never.
