Q: I get married to fix my immigration status but, I’m about to have a baby with my girlfriend how I could do baby sign up

I submitted all the forms for adjustment of status with my American spouse a month ago, however in a few days I’m having a baby with another woman, what are my options to sign the baby under my name as the father without complicating my Inmigracion process? I heard I have a period of time (1 year) to sign my baby on the birth certificate without problems, also I heard if the mother of my baby signs the baby under her name it’s going to be hard to change the baby’s last name after I finish my Inmigracion process. What will be the best option for signing the baby on the birth certificate.

A: When you file An immigration case, you must answer every question truthfully. So if there is a question that comes up in your interview, or on your application for a green card, that requires you to disclose if you have children, then you have to answer that truthfully.

A: One of my colleagues, Ms. Mulder, has responded with a reasonable concern. However, more information is needed. Did your wife know about the prior relationship and pregnancy in advance? Are you really in love with your wife? If so, you likely have some explaining to do. It is best to prepare for it.

If you marry solely to get a green card, then you have committed a Federal crime. This is unclear. You may have permanently disqualified yourself from being petitioned by a U.S. citizen. This is true, even if a current girlfriend is a U.S. citizen, who may have been otherwise able to successfully petition after a divorce and remarriage.

Perhaps, your only option may be to seek relief from deportation before an immigration judge, if possible. You may not want to take the risk. It is unclear if you have any other option. You, and hopefully an experienced attorney, may have to spend an exceptional amount 'to try to' undue the damage caused to the immigration record. The outcome is unclear without further discussion and evaluation.

I 'strongly recommend' that you seek legal advice from a competent and experienced immigration attorney who understands INA Section 204(c), among other laws that can complicate the situation. This evaluation takes more time and commitment.
