Q: I filed a SAPCR case in March 2019. There’s been no movement is there anything I can do?

I filed to have my daughters last name changed and to get full custody. Since filing it has now been over a year since we’ve had any contact from her biological dad. We are at the point where an attorney ad litem has been appointed and paid but it’s been 6 months and she refuses to file the paperwork to the court even though her search for the father has been unsuccessful.

A: If you are represented by an attorney, ask him or her what could be done to move the case. If you are pro se, you will likely need to hire an attorney to advance the case for you.

A: More information is needed to determine why the ad litem is refusing to submit paperwork to the court.

It is the job of the publication ad litem to make sure that the other party is properly before the court and all efforts have been made to find that person.

The court will not move forward with the case until this determination is made.

So, you should contact ad litem to find out what is going on.

If you are unable to solve the issue with ad litem on your own, you should hire an attorney.
