Q: I'm a stay at home mom with 3 young children, if my husband wants a divorce can he take my kids from me?

He controls all the money. We only have 1 car and wants to kick me out without my kids. I'm not leaving my kids. I have 2 that are still nursing.

A: Hire a lawyer, file first and get some safeguards in place to prevent all those things from happening.

A: In Kentucky there is a presumption that both parents should see the children 50% of the time and both parents should have joint custody and decision-making. That presumption can be overcome if one of the parties has problems like using drugs or it is not in the best interest of the children to see both parties half the time. Every case is different and you need a skilled lawyer to advise you. Generally a person can’t just take the children from another person without other problems. In addition, if he truly makes all the money you may be entitled for him to pay some of your attorney fees.
