A: Hello,

Congratulations on your future marriage! Yes, it is possible in most circumstances, for you to stay in the USA and apply for a marriage based green card. The process is discussed in detail on my website: https://www.musillawfirm.com/immigration-services/marriage-based-adjustment-of-status/ If you have further questions, you can reach out for a free consultation at my office or any other qualified immigration lawyer.

A: If the person entered the country legally, which it appears to be the case, and they get married to a US citizen, then the US citizen can sponsor them for a green card, despite that they overstayed their visa, and they do not have to return home to process that green card.
