You would need to make sure the name is available. As to the form of business, an LLC might be perfect for one person with a certain kind of business but it might not be right for someone else. The type of business also controls what contracts you may need. Also keep in mind that you will want to consider protecting your brand with a trademark. There is a lot to consider but it really requires a consultation with a business attorney who can ask you specific questions and advise you accordingly.
