Bourbonnais, IL asked in Family Law, Estate Planning and Elder Law for Illinois

Q: How does Guardianship relate to marital rights? My husband had a stroke July1 and his kids showed up with signed Power

of Attorney forms that he didn't remember signing. They completely took over...changed locks on husband's house, closed all of our joint accounts leaving me with no phone, no car insurance and no house insurance. They took over finances and I haven't seen a cent of his money since July and am financially drowning! They have placed him in a nursing home 100 miles from here (closer to them) so it's a 200 mile trip for me to visit him....and I'm 78 yrs old! However they have blocked me from any contact of any sort since Sept. with no explanation. Finally, last week the son said that hubby was upset after I visited and was rude and gruff to staff, so they blocked me! It was probably because I told him that son had sold hubby's life insurance and hubby questioned him! Evidently all money goes to nursing home...house is now going into foreclosure so we lose all investment! I am 1/2 owner yet was never consulted or even notified that was what they were doing. Now I have foreclosure record!

A: I'm so sorry to hear about these circumstances. I think you may need to consider hiring an attorney to have better communications with your husband's children to reach a resolution.

You may also want to consider reporting this behavior to the senior service agency in your area, as you're a senior yourself.
