Q: TX: Renting out room via month to month lease. Tenant hasn't paid second month of rent and is nonresponsive.

I am renting a room out in my own home. Tenant moved his belongings in and 7 days later left to somewhere out of state. Signed lease calls for 30 days notice. I notified the tenant they were late on their rent the day after it was due (per lease). Tenant said I was trying to squeeze every dollar out of him (I brought up that he didn't pay his deposit that he promised he would pay after two weeks) and texted me he wanted to end the lease. I told him he could move out at the end of his second month per the 30 day notice. I emailed him a late rent notice after 6 days. He hasn't paid me or responded to me. His cell phone automatically goes to voicemail and he doesn't answer his emails or texts. His possessions are still in the room. He didn't sign and send me the CDC memo. What can I do? Eviction lawsuit seems like it would be costly, but I cannot rent out the room with his belongings in it. Can I just move his belongings into the garage and rent out the room?

A: It sounds like you both want to terminate the lease, and that you may have agreed to do that at the end of the month following the 30 day notice. Once the lease has ended, you can, and may need to, file an eviction.
