Washington, DC asked in Civil Litigation, Construction Law and Insurance Bad Faith for Maryland

Q: Insurance breached settlement agreement. WHY?

Why would a insurance company breach a settlement agreement?? I settled a property damage claim with an insurance company. Property damage 60k Personal property also 60k. Under the settlement agreement they had to do work on my condo to make the condo watertight, hiring an engineer for certification and environmental certification. They also had to pay me ALE until the condo was Certified. I have been in a hotel for almost a year this work was to take 6 weeks. Anyway the ins attorney has stopped all contact and the engineer became terminally ill in Oct and they never rehired a new engineer. I don't know what to do? I maybe put on the street. I am scared. I just want to know your thoughts on why an insurance company would just breach a settlement. Their cost for repairs and monetary settlement maybe attorney fee in this figure is around 360k. My condo is only worth 150K I wish an attorney would give me their thoughts on this. Thank you

A: If you do not have an attorney, then I certainly recommend that you hire one at this time to assist your in either enforcing the settlement agreement and/or reaching an alternate resolution-----a lot of times the insurance company will not proceed accordingly without an attorney on the other side.
