Q: Can me and my brother (my household member) sponsor my husband?

Hi, My brother is my only household member. We are signing form i864a and I need his income to add up on my income so that we meet the requirements for sponsoring my husband. Both of our incomes combined add up to 42000$ annually, which is sufficient for 3 or more household members. BUT We BOTH haven't filed taxes in the previous years due to low income. WE WERE NOT REQUIRED TO FILE and have NO TAX RETURNS for the previous years. Im uploading seperate statements for me and my brother explaining why we were not required to file and also my brothers w2 and also evls from our current employers and also paystubs as proof of income. and the rental lease of living together. Will this be sufficient to get approved?

A: Your question doesn't state whether you are applying for Adjustment of Status in the US or Consular processing. If you are doing consular processing, NVC will let you know through a CEAC message if they think that based on the evidence you submitted whether you and your brother do not qualify to sponsor your husband. The officer at the Embassy will make the final determination during the visa interview. If you are doing Adjustment of Status you may receive a Request for Additional Evidence asking for more evidence or another sponsor. If you can't provide sufficient additional evidence or another sponsor, your application may be denied before you even get to the interview. Either way, you should have an opportunity to fix the problem before a decision is reached on your application. Hopefully by the time they ask you for it, if they do, you will have a longer history of stable and sufficient employment. Best wishes!
