Q: just signed a pool contract & gave 5k deposit nothing has gone to permit yet company revoked by bbb can i request refund

last night april 15 , 2021 i saw the news is investigating this pool company olympus pools for many complaints and unfinished projects. since we are not all the way in financially a down payment given on credit card for 5,000/ can i back out with the reason extremely leery, worried that they will have us sitting with a whole in back yard and no pool and hoa on our back or fining us for their delays as per others complaints in the bbb and facebook . contract signed on april 7 per agent was sending to permitting and then will run card. ran card on april 9 / but city has no permit info requested by olympus i called today / and olypus told us today it still has not gone to permitting but will be going soon and they are working to rectify previous customers complaints and issues do we have recourse for any or all these reasons to request deposit back.
