Oceanside, CA asked in Personal Injury and Landlord - Tenant for California

Q: Neighbor tenant made false complaint against me, landlord wants to inspect my unit of false complaint. Unit inspected 2x

Complained unreasonable slamming/banging of walls and doors since Oct 2020, landlord told me to record duration and how many times, nothing done. Called police, incident report late March. Demand letter from atty sent April 8th to neighbor, a copy to landlord. Last week, neighbor tenant made false complaint about me banging, and landlord wants to inspect my unit due to false complaint. 2nd time landlord inspected my unit. First inspection was April 16th. When I complain about downstairs banging or slamming now, landlord tells me about a complaint I supposedly did from downstairs, hence the need for inspection of my unit.

My rent is past due, but being processed for Rental Assistance with the County. My case worker called Friday, May 7th saying she needs rent balance for May 2021 to include in rental assistance.

A: i suspect the Landlord is looking for a legal excuse to get you out.

A: Make sure to document anything your neighbor is doing so you can use it as proof later if needed. Your landlord can legally enter your unit upon providing at least 24 hours written notice.
