With that being said there are more details needed to answer your question accurately. In short it depends- if you are living there also and this is a marital property then you have rights as well and she can stay if you want her to. If you have no rights to the property (a whole different issue) then he can say who stays and goes, but he may have to evict her in order for it to be enforced. As I said - it depends and you need to consult with an attorney to let them gather all the facts of your case.
