Q: Can the DA up your charges if you refuse their plea agreement?
I was offered a harsher sentence than if I would have been found guilty. I pointed this out to my public defender. He said if I didn't take this plea they were going to up my chargers. I'm charged with Procure for prostitution. 1st offense. He said I had priors. A DUI that was dismissed 8 years ago. A battery charge from 1994 that was dismissed. All I have on my record is a DUI from 20 years ago a poession of weed in 1994. In a different state. Felt more like a public prosecutor rather than a public defender. Can they now "up my charges" as he says?
A: They can charge anything the facts support and then some…the answer to this is to have competent counsel and a trial by jury, best of luck.
