New Port Richey, FL asked in Family Law and Child Support for Florida

Q: CS is through IL, we live in FL, it is up for review 1/8/22, but the mother moved to IA. Does CS jurisdiction change?

We live in FL (3 yr) The mother lived in IL. She got a divorce and moved to Dubuque, Iowa. She also was ordered to change her name in her divorce, to her maiden name, her name was H** before her second marriage, but her original maiden name was C**, we aren't sure which name she will legally have. The attorney general of IL is investigating the case, we just found out. IL has no known address or record of a name change. We mail CS weekly, and we are not behind. When reviewed, will IL continue jurisdiction? Does she have to modify it for changes to take place? Would FL possibly take jurisdiction, since its known that we live in FL? Or IA, since she lives there? Or if no one does anything, will it just stay the same? She lives off the state in IA, works in WI, and gets child support through IL. She is a known welfare worker... and with no known addresses on record.....for either parent. IDK what to do or expect.

A: No, the Florida courts will probably not obtain jurisdiction to modify the Illinois child support judgment. For the Illinois review hearing, you should ask your question in Justia > Ask a Lawyer > Illinois > Family Law.
