A: It’s a 5 point offense. That’s 3 points away from a 6 month suspension, and an automatic point suspension conference before the MVA. Any result other than not guilty will extend your provisional license another 18 months. You must request a trial (NOT a waiver hearing). If the officer does not show, you plead not guilty and you will be found not guilty. Since you can’t count on that, take the Driver Improvement Program class on the MVA website before you go to court. Bring the proof of completion. If the officer shows and you’re found guilty, show the DIP completion certificate and ask for a “probation before judgment” (PBJ). If granted, you will have no points and the conviction will be stricken from your record so it won’t show on your driving record (and your or your parent’s insurance rates won’t explode through the roof). Unfortunately, a PBJ will not prevent extension of your provisional license for another 18 months, but it’s better than a conviction and 5 points. If the judge denies the PBJ, you should at least get the points reduced to 1 or 2 points. There are other ways a lawyer knows to beat a speeding ticket, if you want to spend money for a lawyer.
