Asked in Adoption, Child Custody, Child Support and Family Law for Florida

Q: Can I petition for custody of my grandson? Or at least try to get visitations established thru the court?

I had been raising my 6 1/2 grandson all his life. 100% by myself for the past 5 years with no help from his mother(my daughter) or his dad. 3 weeks ago his father showed up with his name finally on the B.C. & they also called DCF making outrageous false allegations concerning my 16yo son. The DCF worker stated that I had to let him go from the only home hes ever known. He was being treated for ADHD & being evaluated for autism. It's been 3 weeks & the father wont even allow me or anyone in my home to speak or see the child. My daughter is in communication but since I wouldn't go visit due to covid we barely go anywhere she got upset & decided to call my grandson father to pick up his son just for spite. I've been living in the same home for 16 years Ive had the same phone number for over 10 years. Yet neither parent ever helped support my grandson or visit him & now that he is going to school & that the government is giving so much in stimulus now they showed up. Im desperate for help

A: You should consult with an attorney that can assist you after getting more information on your particular case. You could file a Petition for Temporary Custody by Extended Family in Family Court where a Judge will make a determination on whether or not it is in the child's best interest that you have temporary custody while he establishes a relationship with his biological father and mother.
