Q: I have court tomorrow and have not been able to find an attorney for a criminal case. how do I get a continuance?
A:
If this is your first court setting, you may be able to get a continuance. If you have an attorney you want to hire but just don't yet have the funds yet to hire the attorney, you should inform the court of that and be prepared to have the attorney at your next court date. It also helps if you are not requesting a public defender and acknowledge you have to hire an attorney and are not asking for too long of a period of time to have an attorney (don't ask for more time than is absolutely necessary to have the funds, but be sure you can have the attorney hired by then). If you have not talked to any attorneys to know that you can't afford one, you should try to do that before even going. Some judges won't let you just continue your case because you don't have an attorney - they will tell you be back in a few hours with an attorney. Depending on the county, you could be faced with the ultimatum of being back in a few hours with an attorney or your bond being revoked and going back to jail.
If this is not the first time you have requested a continuance to hire an attorney, best of luck.
