A: Attempted murder charges will still be viable if there were one or more persons in the car at the time he shot at the car. Murder charges can be based on less than an intent to kill upon a showing that the person had a reckless disregard for human life at the time he pulled the trigger. Shooting at a vehicle that is occupied by 1 or more persons shows that reckless disregard for human life even if he had no intent to kill.
