North Hollywood, CA asked in Legal Malpractice for California

Q: Can I sue a free legal aid lawyer for failure to deliver legal services and working/talking with the plaintiffs attorney

She failed to go to my court date to emergency xparte to appeal a judge's default decision on a unlawful detainer due to my absence on the original court date. She then later mislead me by saying that the judge wouldn't appeal his decision even tho my landlord hadn't gave me any proper notice to terminate tenancy and had no cause and no fault. She said judge's are landlord friendly and it was a conflict of law and my best bet would be to make a contract deal to leave within a few weeks if he agreed to give me a good reference and not give me an unlawful detainer and dismiss any back rent owed to him. So I left and am now staying in my rv on the streets and he maliciously gave false/bad references to multiple property management/owners I have documented. She now has contacted his attorney and presented my evidence to him and nothing has been done and she hasn't answered my questions as to why not she tells me to contact her if it happens again and we go from there. What do I do?

A: You are entitled to terminate your relationship with your attorney at any time. Sorry to hear you are having such problems regarding your living situation at this difficult time. Legal Aid attorneys usually deal with defending indigent people (people who cannot pay for legal services) against lawsuits. Now you have claims against this former landlord for defamation and other claims. You may be able to hire/retain a private attorney to represent you in a lawsuit to obtain money from this LL. Please look for one in your local area. They may even take your claims on a contingent fee basis. Hang on to your Evidence, make copies of it.
