Q: Can our landlord evict us if we can’t find a new home if she is selling the home?

We’ve been living at our residence for 3 years. Our landlord is selling the house and our lease ends September 30. We’ve been trying to find a home but it’s been very hard because the rental industry right now is very low. We’ve been working endlessly to find a home to move out but we just haven’t been able to. Our landlord said if we don’t find a home she will have to start the eviction process. We have paid our landlord on time and never had a problem. We are willing to pay for another month if she’ll let us but she doesn’t want to. She wants to get rid of the house. Can she evict us on the grounds that we can’t find a home. We are not behind on payment, its just we cant find a home in such short time.

A: She is not evicting you because you can't find a home. She is evicting you because you would be staying past the end of your lease, and she has elected to not renew it. Your issue with finding a house is not her issue, its yours. She doesn't have to give you a reason to not renew your lease; in fact she could let the house stay vacant on purpose and you still wouldn't have any right or reason to stay or complain. She is selling, and selling with tenants is much more difficult that when the property is empty. You do not want an eviction to be filed, because that will make it difficult to rent anything nice at an affordable price.

I am only writing this to be sure you understand everything involved here.

If your lease is up September 30, you have less than two more days to find somewhere to go--UNLESS the owner allows you to stay on for a few more days to allow more time for you to vacate.

So my advice is to ask the owner if they will allow you a few days (you will have to pay something for this solution).
