Asked in Immigration Law

Q: Do I need to include a child US citizen in my DS -260 form?

I am a DV lottery 22 winner. I submitted my DS 260 on 05/26/2021. My equation is? I didn't add my first daughter Miral. She is 7 years old, on my DS 260 form and my wife's DS260 form because she was born in the USA in 2014 and she is a US citizen. What should I do? I ask KCC to reopen my DS260 and add her or keep everything like now.

A: You can both try to explain at the interview, nothing more. It is always best to get legal assistance from a competent and experienced immigration attorney when the process is started. Perhaps, before there are any other complications. Good luck.

The above is general information, not legal advice, and does not create an attorney client relationship.

A: Applicant must include all minor children into that DS260 regardless of their nationality and whereabouts.

A: Once you have been approved the application can not be amended. HOWEVER, you have the argument that you did not list your daughter because she is a United States citizen and does not need a visa. You should have listed her as one of your children but NOT as one of your family members seeking an immigration visa. At this point your only alternative is to explain at the interview.
