Q: Can a debt collector put a lien on my home if my daughter is on the mortgage as well and the debt is not hers

A: In Georgia, the creditor would first have to sue you in one of the state courts and then obtain a judgment against you. Then that creditor can record that judgment on any property that you have, real or personal property. This includes any property that is owned by multiple parties including that debtor regardless if the other owners are responsible for the debt or not. However, the creditor would only be entitled to a lien that is equivalent to their ownership percentage share in that property. For example, if A and B own a real property equally, then a judgment creditor could place a lien on the real property but only for half of the real property's value.
