Burbank, CA asked in Tax Law and Employment Discrimination for California

Q: my boss gave me a 2-week suspension, during which, i saw my job on craigslist, and wasn't allowed back to work.

I worked for my (ex)boyfriends family business for over a year and about 2 months after we broke up i started seeing a coworker when my ex found out he punched the coworker and the boss "his dad" said we all 3 had to have a 2-week suspension to cool off. However, during the 2 weeks, I noticed both of our positions listed on craigslist.. not to mention my ex has a record and the family was afraid if charges were pressed he would go to prison.

I didn't want to press charges. however, I just found out that my taxes were never filed that year and my ex had brought me to their family member who owns a tax service to file for me. I gave them my info, thinking they were going to do their job.

I want to send them an invoice or demand letter so they can resolve this quickly without involving a lawsuit can I send an invoice?

A: In California you are considered to be an at will employee unless you have an agreement to the contrary with your employer about that status. That means you can be terminated at any time and for any reason or even no reason at all. If the employer views you as being a disruption - whether that is accurate or not - you can be terminated.

As to your taxes not being filed, get a tax person to file them now. If the money was properly withheld from your paychecks then you will have little that you could bring a lawsuit about. The employer had no duty to file your returns for you.

Good luck to you.
