Corona, CA asked in Legal Malpractice for California

Q: Wife’s Attorneys refusing to end lawsuit

Father in law had an accident at a hotel and became paralyzed. He started a lawsuit because his attorneys assured him it would be an easy win. He passed away and my wife took over the lawsuit. Long story short they misjudged the case and it has been extremely difficult and time consuming. My wife no longer has the time/resources to continue and has expressed that to her attorneys multiple times. They have refused to listen and continue to pursue in hopes of Recouping some money for their time. They have paid for things out of their pocket while ignoring my wife’s wishes to stop the case. It almost seems like my wife is being held hostage by her attorneys.

A: Offer to compensate the attorneys for their expenses. It's hardly fair to expect them to advance money on a case, expecting to be paid back at the end, and then after they have spent the money, tell them to walk away from it.
