Q: I have proof of someone violating their pre-trial release but no one seems to care. Who do I connect?
This person has been abusing me and And threatening me he tried to put a restraining order on me because I revoked his bond. The judge revoked his bond but gave him a new bond. The restraining order was not granted and now he's threatening to tell the police that I try to run him over because he memorized my license plate. I have a new born with him. I don’t know what to do to keep us safe. He hasn’t Seen our daughter since she's been born because I told him I moved out of state but he seen me the other day texted me telling me I was a liar and then that's when he said that he memorize my plate number and gave me my actual plate number. Now I am worried.I have a receipt where he bought weed out of the county it has his name on it and also standing by a landmark out of the county. He is not supposed to leave the county. I contacted the prosecutors office and never got a call back.I also contacted his PO and did not get a callback. So what should I do.
A:
One option is to walk into a police station with the evidence and report this as a new crime. Under Florida Statute 741.29(6) and Florida Statute 784.046(15), the crime of Violation of a Pretrial Release Condition is committed when a person out on bond for a crime of domestic violence or dating violence willfully violates a condition of the release conditions imposed when setting bond. It isn’t just a violation of bond or conditions of release, it is a new misdemeanor, which will also be a new violation of his probation.
Another option is to call into the prosecutors office and demand to speak to a supervisor, because the prosecutor assigned to the case isn’t responding to you informing him of a victim (you) being threatened by the defendant.
I wish you good luck and safety.
