Q: How do I file contempt of court for visitation in Texas
I haven’t seen my son in 16 years. His mother has kept him away for me, not allowing me to talk to him on the phone, or visit. My son just recently connected with me on Facebook, and has expressed his feelings about wanting to live with me because of things that are going on at home. According to my son, his mother( my ex- wife) has put him through a lot of mental abuse, and has told him lies about me to keep him from having anything to do with me. She has alienated my son not only for me, but also has alienated him from friends. She will not allow him to have friends whatsoever. He is stuck in the house and has no social life. She has taken money from him that he has earned and has spent it on herself, and only giving him a little money to spend. This is the exact same stuff she did to me when we were married. What can I do to help my son?
A:
I believe the best route to go in your situation is to file a Petition to Modify the Parent-Child Relationship. Since your son is over 12 years old, you can ask the Judge to speak with him directly and he can express to the Judge which parent he would prefer to live with and why. Your son speaking with the Judge in no way guarantees that the Judge will give him (and you) what you want (him living with you), but he will at least have a voice in the matter.
I hope this information helps and good luck to you both.
