Q: Is it possible to modify an SAPCR Order? More in details.

Am I able to customize or modify the SAPCR Order itself? I am aware that I can have a Modified Possession order instead of the standard but I am not sure about modifying the SAPCR order. And if I do customize the SAPCR order, will it be accepted by the judge? I would like to customize the medical/dental support sections so that I am only paying out of pocket for expenses when they arise. And I would like child support to be terminated as soon as shared custody happens at age 5 years old.

A: You can modify an Order in Suit Affecting the Parent-Child Relationship (SAPCR). The modification of the Order must be in the "best interest of the child(ren)". If you are trying to modify the Order within 1 year of the current order being signed by the Judge, then you will need to state in an affidavit why you believe it is in the child's best interest that a Judge hear the modification within 1 year of signing the Order. You must also be able to show a material and substantial change in the circumstances of any party to the suit for the Order to be modified. If this is shown, then a Judge will consider your modification suit.

Modifications of court orders are not hard to obtain, but how (and if) they are modified depends on the facts and circumstances of each individual case.
