Asked in Business Law for Florida

Q: Business legal advice.

2. Years ago I got diagnosed with cancer. I'm president of my business with a partner. Now that I couldn't go down there while dealing with this my partner says I'm not aloud to receive any profit from my company because I'm not there at the business right now. She's done forged my name to sunbiz for annual profit report amongst other things. I've had this business for 30 years. Do I have a legal standing for anything? I just want to retire since I've been diagnosed. So for almost 3 years I haven't received a dime from my own company. I know she's getting over on me. I just need to know legally what to do

A: The answer is going to depend on a number of factors, such as the type of business entity, the operating agreement, the division of shares, and other things. I recommend that you consult with an attorney asap. You can speak to them, send them the relevant documents, and potentially retain them to help you resolve the issue. There are statutes of limitations for the type of legal action that you may need to bring, which means that you have a limited time to sue for certain things.
