Q: How long can a child custody case stay open in KY with no pursuit from either parent in over 19 months?
Once paternity was established in April of 2020 and automatic child support issued by the court neither parent has pursued having the custody issued finalized that was initially filed in December of 2019. Will that case still be open or will it have been dismissed/closed?
A: The case can stay open as long as the court permits it. Each case is determined on the merits of its own facts.
