Rancho Santa Margarita, CA asked in Legal Malpractice for California

Q: After filing basic legal malpractice pro se paperwork & having the atty served, Judge set trial next year. How long--

How long do I have to file the long form paperwork? Or do I not have to YET? The atty made a comment about his needing a responsive pleading extension. This made me think he was going to file something then I would have an atty handle the rest, but I haven't heard or received anything. Now, I'm worried & stressed that I screwed up? Cringing.

A: It is very common for the defense to file a demurrer instead of an answer. It does not mean you screwed up. Even if you did, most mistakes can be fixed on amendment.
