1. From what state agency are you trying to obtain discoverable documents?
2. Is this state agency a party to the Suit Affecting the Parent-Child Relationship proceeding?
Typically, all parties to a lawsuit must follow the Texas Rules of Civil Procedure in responding to discovery requests. However, if you are seeking documents from an agency that is not a party to the suit, the attorneys for that state agency are not required to follow the Texas Rules of Civil Procedure. You would have to make them a party to the lawsuit.
