Tallahassee, FL asked in Immigration Law for Florida

Q: Interfile to EB2 or wait in EB3?

I am from India I have a priority date of EB2 Nov 29th 2011. I downgraded and filed my Concurrent AOS application ( I485+ I140) in August 2021 in EB3 category. My I140 in EB3 was approved in October of 2021. My application was in Texas Service Center and Texas service center is very slow and approving daily 4-5 cases who filed in FY2021.

Now since USCIS is recommending for the people who are eligible to Interfile to EB2.

I am in a dilemma since I am current in both EB2 and EB3. Do I Interfile and move to Eb2 or wait in EB3.

If I interfile to EB2 will my application be sent to National Benefits Center where processing is faster.

Please suggest any pros and cons.

A: You have an investment visa, that means that you have to create and submit legitimate sufficient financial means or funds to qualify for such. Any of such investment Visa require a licensed attorney to submit review and file everything correctly. You would be in the best position to seek an immediate legal advice from a licensed attorney of your choice or the counsel of record.
