Q: Can my health subrogation take all of my settlement from my car accident case
I got my settlement from my case but then my lawyers said that my medical settlement is in a trust fund and that he has got me subrogation lawyer to work on my behalf for the medical part how to long do I have wait to know whether my subrogation lawyer win my case I have received three letter from my medical subrogation rep. One saying that did an investigation on my case and they find that I was not a fault of the accident
A: A South Carolina attorney could advise best here, but your question remains open for three weeks. In general nationwide, the subrogation attorney for the medical insurance interests do not get involved in liability issues. They basically want their money back for your accident-related treatment. Only your attorney could speak meaningfully about the actual lien amount - but insurance liens are sometimes negotiable, based on their proportion to an award. But it could depend on the carrier. This is something your attorney would have the most insight into. Good luck
