Martinsville, VA asked in Criminal Law for Virginia

Q: I am facing 2 class 1 misdemeanors. And ex roommate with a long criminal history reported me for petty larceny.

I have no lawyer. I own my own store. I have no criminal record other than traffic. And I am a business owner in the area. This guy is also a drug addict and he has been nothing but trouble. The larceny was a mistake I own a thrift store and I have merchandise scattered throughout our property. the power in our place had gone out and our house had been robbed several times. And I had on my own private security monitor the extra roommate stealing from us. We recovered some of our own clothes that were scattered down the stairs and a public area of the house. And a drone that I had thought was something from my shop. We needed some cash so I took the drone to the pawn shop for immediate cash. The other thing is unlawful entry of my own home to do damage I don't understand the second offense as it was my own home. I'm going through the court systems in Henry county Virginia what are the chances of me going to jail? I also have Parkinson's disease and my fiance is disabled

A: You said you are "going through the court system" which means you have likely hired your own attorney to represent you or you have a court appointed attorney to represent you. You should speak to that attorney regarding whether you will go to jail since that attorney has the Commonwealth's evidence and thus the strengths and weaknesses of your case, as well as being familiar with the Judges and what arguments on your behalf will fly and what won't.
