Q: This is in regards to medical malpractice. Is this considered “malpractice” or an error on the surgeon’s part? Can I sue

This is in regards to medical malpractice. I had bicep tendon reattachment surgery on my left arm and I can’t twist my wrist. It’s been 10 weeks post surgery. I know people who have had the same surgery and they were able to twist their wrist weeks earlier. There is also numbness in my arm. Could the surgeon have made a mistake?

A: Could the surgeon have made a mistake? Yes. Could the numbness in your arm be attributable to factors other than the mistake of a surgeon? "Yes" to that question as well. An attorney is not qualified to make such a determination. You could reach out to med mal law firms to discuss further. Attorneys generally consult with medical professionals to make those kinds of calls, if they hold a preliminary inclination that the matter warrants more detailed examination. Good luck

A: Although the surgeon could have made a mistake, your condition may also be an accepted and foreseeable risk of the surgery you underwent and not necessarily the result of malpractice. A bad outcome, without more, is not malpractice. As my colleague correctly advised, there is no way an attorney can answer your question without having a chance to look through your medical records and having them reviewed by an appropriate medical expert. Best to follow-up with your physician to find out why you're not recovering as quickly as expected or, if you're not satisfied with the care you're receiving, a second opinion from a different physician altogether.
