A: You should consult an attorney so that they can review the specific facts of your case to determine if there is a 3rd party claim to be made; however, if you were on the clock at the time of the incident this sounds like a straight work comp claim.

A: If you were an employee of the plant owner then you would likely be limited to a claim under the Alabama Worker's Compensation Act. You have very valuable rights that are protected by the worker's compensation act. However, there strict time limits that you must follow to protect your rights under the worker's compensation act. If you were employed by another entity you may have a claim against the plant owner for negligence. I would encourage you to immediately contact an attorney that handles worker's compensation claims to discuss the detailed facts of your employment and accident.

A: Generally in Alabama, if you're injured on the job and on your employer's premises and the injury is due to negligence of your employer or your coworkers, you are limited to worker's compensation. You cannot sue your employer for negligence if you're covered by worker's compensation.
