Q: What happens filing a protected order with the commissioner?
A: The Commissioner will decide if there are sufficient grounds to enter an interim protective order. The case will then be scheduled for a temporary protective order in front of a judge. After taking testimony, the judge will decide if there are sufficient ground for a temporary protective order. If there are, the case will be scheduled for a final protective order in about a week.

A: I agree with Mr. Scherr, each proceeding has a slightly higher burden of proof to grant the protective order. At the temporary protective order hearing a Judge must find "reasonable grounds" supporting the person eligible for relief has been abused. At the final protective order proceeding a Judge must find by a preponderance of the evidence that the person eligible for relief has been abused.
