Saint Paul, MN asked in Criminal Law for Minnesota

Q: What am I looking at for penalties with these-

1st time 4th Degree DUI, 1st time 4th Degree underage drinking, 1st time 4th Degree driving while revocation and driving with no insurance. I already had a small incident last year that put 45 stayed days over my head for a very different offense. These are all misdemeanors and I have no priors but there's 4 charges in total and I don't know if the judge takes that into consideration as well. I'm asking for the state of Minnesota, I wouldn't know if this would make a difference but the jail only held me 6 hours.

A: It’s unclear what exactly you are asking here. But the easiest thing to advise is to get an attorney. A DWI will have direct consequences - jail time, fines, etc. And indirect consequences - DL revocation, insurance rates increase, etc. And you could be facing a probation violation as well. Get an attorney onboard ASAP. There will be an attorney prosecuting you. Don’t fight this battle alone.

A: The questions presented here would be best answered by your lawyer, since the specifics of your cases will determine the best answers that can be given. In terms of executed jail time, the highest risk usually comes from the revocation of probation (in misdemeanor cases.) But the consequences of a public record of criminal conviction can be worse than the temporary jail time. Definitely discuss with your lawyer, or get one if you don't have on already.
